Watersmith Plumbing and Gas Limited Terms and Conditions of Trade
The following constitute the terms and conditions of business between us, the Supplier of goods and services, and you, the Client:
Price
The following rates shall apply where work is to be charged on the basis of time and materials (charge-up basis) and for the purpose of calculating any variation to quoted work. Labour is charged from our Workshop to your job then back to our Workshop and includes any time spent obtaining materials for your job from merchant suppliers.
Prices quoted exclude GST:
- Labour Plumbing $85 per hour.
- Gasfitting $95 per hour.
- Apprentices / labourers from $50 per hour depending on experience.
- AfterhoursCallout Charge $220 (vehicle inc) for the first hour, then standard rates apply.
- Materials Recommended Retail.
- Vehicle charges $30 per Visit.
Where a quotation has been given for work to be performed that quotation remains valid for 30 working days. Your acceptance of our quotation/offer must be confirmed either in writing or by clicking on the Accept Quote button on our email, prior to commencement of work. We may withdraw that quotation at any time before acceptance.
The quotation is based on costs and charges ruling at the date of quotation. Any changes in costs arising from sources beyond our control (for example, changes in prices charged by suppliers to us, or in government charges) shall be to your account.
Payment
Payment of the claimed amount is due and payable by you 7 working days after receipt of our invoice. Where work is undertaken over a period exceeding one month, invoices may be issued for progress payments covering work done and costs incurred up to the date of the invoice. If you disagree for any reason with the claimed amount, you will respond to us in writing before the payment is due. Overdue payments shall attract interest at an annual rate of 10% calculated daily, and any expenses incurred by us in recovering this debt shall be added to your account.
Disputes
If any dispute or difference arises in connection with work done or payments claimed by us, or any other matter pertaining to business between us and you, we or you shall refer the dispute to adjudication in terms of Part 3 of the Construction Contracts Act 2002 (CCA), or to the Master Plumbers Association of which we are a member for settlement through that Association’s Disputes Procedure. For the purposes of s.33(1)(c) of the CCA, the Master Plumbers Association shall be the nominating body.
Ownership
Any goods and materials supplied by us shall remain our property until paid for in full. If any money remains unpaid or you are in breach of any obligation to us, we or our agents are authorised by you to enter your premises to recover and resell any or all of those goods and materials. We may require you to facilitate the registration of a Financing Statement under the Personal Property Securities Act 1999 to give us a Perfected Security in any goods supplied.
Risk
All goods and materials are at your risk once on your premises or premises under your control. Any loss arising from theft, destruction or damage from whatever cause shall be borne by you.
Consents
You are responsible for obtaining any consent or other authority necessary for the work and will provide that to us upon request. Where a building consent is required and you have failed to obtain it, we may lodge a building consent application as your agent and at your expense.
Warranty
Watersmith Plumbing and Gas provide a 2-year warranty on workmanship. We guarantee that we will remedy any defective workmanship and/or replace any faulty material supplied by Watersmith Plumbing and Gas. Any fault must be reported to us in writing within 7 days of identification. All materials and fittings supplied by Watersmith Plumbing and Gas carry a Manufacturer’s warranty generally ranging from 12 months to 25 years depending on the product. If we have supplied the product and it fails we will deal with the manufacturer to correct the problem. If you, the client, provide the materials/fitting and it fails then any work by Watersmith Plumbing and Gas to rectify the situation is chargeable. This performance guarantee does not extend to any goods or materials supplied by you. In the case of work covered by the Consumer Guarantees Act 1993, this warranty is in addition to any rights you may have under the Act.
New Zealand Privacy Act 2020
You authorise us to use information collected from you and to collect information from third parties for purposes relating to the performance of this agreement. We will never sell your information.
Estimates
An estimate is not a fixed price. When we give an “estimate” or “ballpark” figure we are only providing an approximate indication of expected cost. An estimate may vary either way by up to 20% of the original figure given.
Investigation Work
If Watersmith Plumbing and Gas spends time investigating an issue to determine the cause or location of a problem, then the time spent investigating will be charged at our standard hourly rate irrespective of any further work being done. For example: if a quote to fix a roof leak is requested but the cause or location of the leak is not obvious then the time spent identifying the location of the leak is chargeable.
Quotes
Watersmith Plumbing and Gas provides free Quotes. A Quote can be provided when you know exactly what work you want done. You (the client) would generally provide us with a plan and/or specification to outline the job. If you know the outcome you require but not what needs to be done then this may require investigation and advice on our part, which will incur a charge.
Collecting Materials
If our tradesmen have to collect parts or materials from a merchant supplier prior to coming to your property or have to leave your property to collect parts/materials for your job then all time spent travelling to, from and at the supplier is chargeable to you.
Apprentices
Watersmith Plumbing & Gas is a strong advocate for training apprentices and as such apprentices will at times accompany a tradesman to a job free of charge to the client. If, in assisting a tradesman, an apprentice reduces the amount of work/time that a tradesman takes to complete the job then the apprentice will be charged on the job.
Health & Safety
Health & Safety is paramount with regard to our staff, clients and the general public. Two people may be required for some work – such as roof work – to ensure the Health & Safety of all concerned. We reserve the right for our tradesmen to reject or defer a job if they deem conditions to be unsafe. For example: high winds or rain when working on a roof. There are legal Health & Safety requirements for working on a roof. These requirements may add to the cost of the work.
Roof Leaks
In attempting to repair a roof leak our tradesmen will adopt a process of repairing the most obvious faults and then waiting to see if the problem has been solved. If not then the next most obvious faults will be addressed. All of this work is chargeable. Due to the nature of roof leaks, there is no guarantee of repair. The only way we will guarantee a roof is leak-free is if we have installed the complete new roof to the property.
